Restaurant Partner Agreement

Effective 22 July 2026. Partner terms for restaurants on PackKardo.

This Restaurant Partner Agreement (“Agreement”) applies to restaurants and food businesses that list on PackKardo. By completing onboarding or accepting orders on PackKardo, you agree to this Agreement. PackKardo provides the technology platform; you prepare and supply the food.

1. Role of the parties

PackKardo connects customers with your restaurant for advance ordering, in-store pickup, and (where you enable it) car handoff. You are an independent business — not an employee or agent of PackKardo for preparing food.

You are solely responsible for cooking, packaging, labelling, and handing over orders to customers.

2. Commission / platform fee

PackKardo charges a commission / platform fee on qualifying order value as configured for your restaurant in merchant or admin tools (rates are set per partner; a common default is around 7%, subject to change by written or in-dashboard agreement).

The fee applicable to each order is reflected in settlements and reporting available to you.

3. Weekly settlements

Net amounts due to you are settled on the cycle shown in merchant/admin settlement tools (typically weekly), after deducting commission/platform fees, refunds, chargebacks, and other adjustments.

You must keep bank / UPI settlement details accurate. Delays caused by incorrect payout details are your responsibility.

4. GST and taxes

You are responsible for GST registration (where required), charging and remitting applicable taxes on your food sales, and issuing invoices as required by law.

PackKardo is responsible for taxes on its platform fees as applicable under Indian law. Tax treatment may depend on your invoices and filings — seek your own tax advice.

5. FSSAI and legal compliance

You represent and warrant that you will maintain:

  • A valid FSSAI licence (or applicable food-business registration) for the premises fulfilling PackKardo orders
  • Legal business registration as required for your entity type
  • Safe food handling, hygiene, and storage practices
  • Accurate preparation matching the ordered items
  • Timely order acceptance and fulfillment consistent with stated prep times

6. Menu accuracy and operating hours

You must keep menus, prices, item availability, prep times, and operating hours accurate in the merchant tools.

Outdated prices, unavailable items left as available, or incorrect hours that cause customer harm may lead to refunds charged against your settlement and/or suspension.

7. Food liability

You are solely liable for food quality, freshness, ingredients, allergens, hygiene, packaging, foreign objects, contamination, and food-related illness arising from food you prepare, subject to applicable law.

PackKardo is a technology intermediary and does not manufacture or alter your food.

8. Insurance

You should maintain insurance as required by law and as prudent for a food business (for example public liability / product liability where applicable). PackKardo does not insure your food or premises.

9. Indemnity

You agree to indemnify and hold harmless PackKardo and its officers from claims, losses, and expenses arising from your food, FSSAI or licensing failures, menu inaccuracy, employee conduct at your premises, or your breach of this Agreement, except to the extent caused by PackKardo’s own wilful misconduct.

10. Suspension and termination

PackKardo may suspend or terminate your listing for non-compliance, safety concerns, fraud, repeated customer harm, unpaid obligations, or material breach of this Agreement.

You may request deactivation via merchant support. Outstanding settlements, refunds, and chargebacks remain payable after termination.

11. Car handoff (if enabled)

If you enable car handoff, you must follow the handoff flow (verify pickup OTP / customer details as designed in the app) and only release orders to the correct customer at the designated point.

12. Privacy and customer data

Use customer phone numbers and order details only to fulfill PackKardo orders and lawful support — not for unrelated marketing unless you have a separate lawful basis. See also the PackKardo Privacy Policy.

13. Governing law

This Agreement is governed by the laws of India. Courts having jurisdiction in Chandigarh shall have exclusive jurisdiction, subject to mandatory law.
